inQbation™ takes your privacy and the privacy of your personal information very seriously. We will use your information only in accordance with the terms of this Privacy Policy. We will not sell or rent your personally identifiable information (PII) or a list of our customers to third parties.
However, as described in more detail below, there are limited circumstances in which some of your information will be shared with third parties, under strict restrictions, so it is important for you to review this Privacy Policy. This Privacy Policy applies to all services that are hosted on the inqbation.com Web site, whether the services are offered by inQbation™, by its subsidiaries, or its affiliate merchants.
This Privacy Policy applies to www.inqbation.com and covers how inQbation™ treats personal information that inQbation™ collects and receives, including information related to your past use of inQbation™ products and services. This policy does not apply to the practices of companies that inQbation™ does not own or control or to people that inQbation™ does not employ or manage.
These sites are governed by their own privacy statements, and inQbation™ is not responsible for their operations, including but not limited to their information practices. Visitors submitting information to or through these third party Web sites should review the privacy statement of these sites before providing them with personally identifiable information.
In order to operate inQbation™ and to reduce the risk of fraud, we must ask you to provide us personal information about yourself, your business operations (if applicable) and and/or Google™ Checkout account information. Personal information is information about you that is personally identifiable like your name, address, email address, or phone number, and that is not otherwise publicly available.
By accepting the Privacy Policy and User Agreement in registration, you expressly consent to our use and disclosure of your personal information in the manner described in this Privacy Policy. This Privacy Policy is incorporated into and subject to the terms of the inQbation™ User Agreement. This Privacy Policy will take effect on May 15, 2007.
Please note that your personal information will be stored and processed on our computers in the United States. The laws on holding personal data in the United States may be less stringent than the laws of your country but inQbation™ will hold and transmit your personal information in a safe, confidential and secure environment. If you object to your personal information being transferred or used as described in this Privacy Policy, please do not register for the inQbation™ service.
Since inQbation™ creates legally enforceable contracts and according to most US Contract Laws, children are not deemed "competent" parties to a contract, children are not eligible to use our service and we ask that minors under the age of 18 do not submit any personal information to us or use the service. Further, since we firmly believe in protecting the privacy of children, especially those under 13, we strictly forbid the use of inQbation™ by minors. Please see: (FTC COPPA)
"Merchants" and "vendors" are professional business entities that provide products and services to the general public. Merchants and vendors register with inQbation™ for the purpose of calendar sharing, contract generation, and lead generation. Merchants and Vendors are referred to within this document hereafter as "merchants".
"Consumers" are individual persons contracting the services of Merchants through the inQbation™ website. "Website visitors" are any persons visiting the inQbation™ website on an anonymous basis, i.e., not logged into inQbation™. Website visitors are referred to within this document hereafter as "visitors".
The information we gather falls into two categories: 1) personal information you voluntarily supply when you register as a merchant through inQbation™, generate a contract with a merchant through inQbation™, provide your e-mail address, and 2) tracking information collected as you navigate through our sites.
Anyone can view our sites, but a free registration process is required to access the full range of information and services offered across our different sites. inQbation™ requires that you supply a unique e-mail address and demographic information, job industry and job title (if applicable) to register. By using inqbation.com, you are agreeing to the terms of our member agreement.
inQbation™ uses "cookies" and other technologies to track visitors, identify click patterns, and help us understand which parts of our Web sites are the most popular, where our visitors are going and how much time they spend there. Users who do not accept cookies from the domain "inqbation.com" cannot access most areas of our sites.
inqbation.com is currently using Google Analytics, a third party, to track and analyze non-personally identifiable usage and volume statistical information from our visitors and customers to administer our Web site and constantly improve its quality. All data collected by Google Analytics on behalf of inqbation.com is owned and used by inQbation™. inQbation™ reserves the right to publish non-personally identifiable, summary information regarding its Web site visitors for promotional purposes and as a representative audience for merchants. Please note that this is not personal information, only general summaries of the activities of our visitors and customers. inQbation™ logs IP (Internet Protocol) addresses, or the location of your computer on the Internet, for systems administration and troubleshooting purposes. We use the IP address log in an aggregate fashion to track access to our site.
inQbation™ complies fully with the federal CAN-SPAM Act of 2003. We will not share, sell, rent, swap or authorize any third party to use your e-mail address without your permission. If you feel you have received an e-mail from us in error, please contact inquiries@inqbation.com.
inQbation™ reserves the right to send you e-mail relating to your account status. This includes order confirmations, transactional e-mails and notifications about major changes to our Web sites and/or to our Privacy Policy.
inQbation™ may offers several e-mail newsletters. If you no longer wish to receive a specific newsletter, follow the "unsubscribe" instructions located near the bottom of each newsletter. To manage your inqbation.com e-mail preferences, please visit your profile. If you choose to receive them, inQbation™ may periodically e-mail you messages about products and services that we think may be of interest to you. You can choose not to receive messages in the future by either (1) following the "unsubscribe" instructions located near the bottom of each e-mail, or (2) you can opt-out.
When you sign up to receive e-mail from us, you can select either plain text or HTML (with images) format. If you select the HTML format, we may place a one-pixel gif to determine whether or not readers viewed the e-mail. This process does not leave any information on your computer, nor does it collect information from your computer. inQbation™ may share this data with others in aggregate only. If you send us e-mails, you should be aware that information disclosed in e-mails may not be secure or encrypted and thus may be available to others. We suggest that you exercise caution when deciding to disclose any personal or confidential information in e-mails. We will use your e-mail address to respond directly to your questions or comments.
inqbation.com readers may use this feature to send links to articles to others through e-mail. The e-mail address(es) that you supply to this service will only be used to send the requested article.
inQbation™ will not sell, rent, swap or authorize any third party to use your e-mail address or any information that personally identifies you without your permission. We do, however, share information about our audience in aggregate form.
We contract with other companies to provide services on our behalf, including credit-card and billing processing, shipping, e-mail distribution, list processing and analytics or promotions management. We provide these companies only with the information they need to perform their services. These service providers are restricted from using this data in any way other than to provide services for inQbation™, and they may not share or resell this data.
We reserve the right to disclose your opt-out information to third parties so they can suppress your name from future solicitations, in accordance with applicable laws. We may occasionally release personal information as required by law, for example, to comply with a court order or subpoena. If you are a consumer of a merchant registered through inQbation™, we will provide the basic contact information that you provide in order for the merchant to fulfill the terms and conditions of their contract with you. If you are buying goods or services and paying through inQbation™, the seller of the goods or services may request that you provide a mailing address. You do not have to provide this information. If you do not provide the information, however, the seller may choose not to complete the transaction.
In order to facilitate the transactions between inQbation™ merchants and their customers, our service allows merchants limited access other consumers contact or shipping information. As a merchant you may have access to the email address and other contact or shipping information of the consumer, and as a consumer you may have access to the email address and other contact information of the merchant.
We respond to subpoenas, court orders, or legal process, or to establish or exercise our legal rights or defend against legal claims. We may disclose personal information if we are required to do so by law or we in good faith believe that such action is necessary to (1) comply with the law or with legal process; (2) protect and defend our rights and property; (3) protect against misuse or unauthorized use of our Web sites; or (4) protect the personal safety or property of our users or the public (among other things, this means that if you provide false information or attempt to pose as someone else, information about you may be disclosed as part of any investigation into your actions).
As with any other business, it is possible that inQbation™ in the future could merge with or be acquired by another company. If such an acquisition occurs, the successor company would have access to the information maintained by inQbation™, including customer account information, but would continue to be bound by this Privacy Policy unless and until it is amended as described above. We transfer information about you if inQbation™ is acquired by or merged with another company. In this event, inQbation™ will notify you before information about you is transferred and becomes subject to a different privacy policy.
inQbation™ is committed to handling your customer information with high standards of information security. We maintain physical, electronic and procedural safeguards that comply with federal regulations to guard your nonpublic personal information. We test our security systems regularly and also contract with outside companies to audit our security systems and processes.
The security of your inQbation™ account also relies on your protection of your inQbation™ password. You may not share your inQbation™ password with anyone. If you do share your inQbation™ password with a third party for any reason, including because the third party has promised to provide you additional services such as account aggregation, the third party will have access to your account and your personal information, and you may be responsible for actions taken using your password. If you believe someone else has obtained access to your password, please change it immediately by logging in to your account and changing your Profile settings, and also contact us immediately.
inQbation™ will never ask you to send your password or other sensitive information to us in an e-mail, though we may ask you to enter this type of information on the inQbation™ website, which will always have a URL beginning with https://www.inqbation.com/. Any e-mail or other communication requesting your password, asking you to provide sensitive account information via email, or linking to a website with a URL that does not begin with https://www.inqbation.com/ should be treated as unauthorized and suspicious and should be reported to inQbation™ immediately by forwarding the email to inquiries@inqbation.com.
You can review the personal information you provided us and make any desired changes to such information, or to the settings for your inQbation™ account, at any time by logging in to your account on the inQbation™ Web site and changing your preferences in the Profile page. You can also close your account through the inQbation™ Web site. If you close your inQbation™ account, we will mark your account in our database as "Closed," but will keep your account information in our database. This is necessary in order to deter fraud, by ensuring that persons who try to commit fraud will not be able to avoid detection simply by closing their account and opening a new account. However, if you close your account, your personally identifiable information will not be used by us for any further purposes, nor sold or shared with third parties, except as necessary to prevent fraud and assist law enforcement, or as required by law.
This Privacy Policy may be amended from time to time. Any such changes to this Privacy Policy will be prominently posted on our Web site so that you can always review what information we gather, how we might use that information, and whether we will disclose it to anyone. If we make a significant or material change in the way we use your personal information, we will post these material changes to the News section located on our home page, www.inqbation.com.
